These Terms and Conditions ("Terms") govern your access to and use of Kiwi, including the Kiwi mobile applications, websites, APIs, dashboards, and related services (collectively, the "Platform"). This website is managed and operated by MoonTech FZE, TL#23701 ("Kiwi", "we", "us", or "our").
By creating an account, accepting these Terms, listing a business, making a booking, placing an order, subscribing to a plan, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Kiwi is a marketplace and booking platform that helps customers discover stores, branches, services, products, experiences, providers, workers, offers, and related business information. Kiwi may enable reservations, product orders, reviews, complaints, notifications, payments, subscriptions, wallet activity, and support requests.
This website and the Kiwi Platform are managed and operated by MoonTech FZE, TL#23701.
Unless expressly stated otherwise, Kiwi is not the seller of products or the provider of booked services. Providers, stores, business owners, workers, and branches are responsible for the services, products, schedules, prices, staff, business information, and customer experience they provide through the Platform.
You may use the Platform only if you can enter into a legally binding agreement under applicable law. If you use the Platform on behalf of a company, store, branch, or other organization, you confirm that you are authorized to bind that organization to these Terms.
You must provide accurate and current information when registering or using the Platform. You are responsible for maintaining the confidentiality of your account, verification codes, passwords, tokens, and devices.
The Platform may support different account types, including:
Customers, who search, book, order, review, complain, and manage their profile.
Providers and business owners, who create and manage stores, branches, services, products, equipment, workers, schedules, subscriptions, payments, payouts, and customer interactions.
Workers or staff, who may be assigned permissions by a provider or business owner.
Admin users, who manage and moderate the Platform.
Your available features depend on your account type, permissions, subscription plan, store approval status, and applicable Platform rules.
Kiwi may use phone, email, OTP, social login, Firebase, device tokens, or other verification methods. You must not attempt to bypass verification, create accounts using false information, impersonate another person, or use another user's account without permission.
We may reject, suspend, restrict, or close an account if we believe the account information is inaccurate, unauthorized, fraudulent, harmful, inactive, or in breach of these Terms.
Customers may use the Platform to request reservations, book services, order products, apply coupons, submit notes, choose payment methods, view order or booking status, and contact support.
You agree that:
Booking availability, service duration, worker assignment, branch availability, and product stock may change.
A reservation or order may be accepted, rejected, rescheduled, cancelled, or marked no-show according to the provider's rules and Platform policies.
Prices, taxes, service fees, delivery fees, discounts, and totals are shown before confirmation where applicable.
You are responsible for providing accurate contact details, address details, booking notes, and other information needed to complete the order or reservation.
You must arrive on time for reservations and follow the store's reasonable policies.
Providers, business owners, workers, and store representatives agree to:
Provide accurate store, branch, service, product, equipment, price, availability, media, working-hour, and contact information.
Keep licenses, permits, approvals, staff qualifications, and insurance required by applicable law.
Honor confirmed bookings and orders unless a reasonable operational issue requires cancellation or rescheduling.
Provide services and products safely, professionally, lawfully, and consistently with the information published on the Platform.
Manage customer data received through the Platform only for legitimate booking, order, support, and business purposes.
Keep bank account, payout, wallet, subscription, and tax information accurate.
Avoid misleading content, fake reviews, duplicate listings, prohibited products, unlawful services, spam, abusive behavior, or attempts to manipulate search, ranking, ratings, coupons, or analytics.
Kiwi may review, approve, reject, suspend, deactivate, or remove stores, branches, services, products, media, reviews, provider accounts, worker accounts, and other content at its discretion.
Some provider features may require a subscription plan, service fee, commission, or other charge. Plan features, limits, prices, renewal terms, cancellation rules, and support levels may be displayed in the Platform.
You authorize Kiwi and its payment partners to charge applicable fees, including subscription fees, commissions, service fees, taxes, penalties, refund adjustments, chargeback amounts, and other amounts disclosed to you.
Provider payouts, wallet balances, withdrawal requests, bank account transfers, and settlement timing may depend on payment provider processing, risk checks, refunds, chargebacks, bank availability, and applicable law.
Payments may be processed by third-party payment providers. Kiwi does not control all bank, card network, payment gateway, or wallet processing rules.
If the Platform supports saved cards, card details may be stored as tokens, masked card numbers, or payment references through payment infrastructure. You must only use payment methods that you are authorized to use.
Refunds, cancellations, failed payments, partial payments, subscription renewals, chargebacks, and payment disputes may be handled according to the provider's rules, Kiwi policies, payment provider rules, and applicable law.
Users may submit reviews, ratings, replies, reports, complaints, support messages, photos, attachments, community posts, and other content. You are responsible for the content you submit.
You agree not to submit content that is false, misleading, defamatory, abusive, hateful, obscene, discriminatory, infringing, private, illegal, spam, or unrelated to a genuine experience.
Kiwi may moderate, hide, edit, remove, investigate, or escalate content and reports. Reviews and ratings may affect store, branch, service, product, provider, and worker visibility or analytics.
If you upload images, documents, profile photos, store logos, covers, product media, complaint attachments, support files, or other media, you confirm that you have the right to upload and use that media.
You grant Kiwi a non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, resize, moderate, and use uploaded content as needed to operate, market, secure, and improve the Platform.
Kiwi may display business information submitted by providers, imported from public sources, received from third parties, or generated through operational tools. If you believe a business listing is inaccurate or you are authorized to claim it, contact us at [support email].
Claiming a store or business listing may require verification, documents, reservation history, phone verification, or other checks.
You must not:
Violate any law, regulation, third-party right, or Platform policy.
Access, scrape, reverse engineer, overload, disrupt, or attack the Platform.
Upload malware, harmful code, or unauthorized tracking technology.
Misuse coupons, referrals, payments, refunds, reservations, reviews, notifications, APIs, or support channels.
Harass, threaten, discriminate against, or harm another user, provider, worker, admin, or customer.
Collect, sell, or misuse personal data obtained through the Platform.
Circumvent account limits, permissions, subscription requirements, security controls, or fraud checks.
We may add, remove, suspend, restrict, or modify Platform features at any time. The Platform may be unavailable due to maintenance, updates, outages, third-party services, security incidents, force majeure events, or operational issues.
We do not guarantee that the Platform will be uninterrupted, error-free, compatible with every device, or available in every location.
Kiwi, the Platform, software, APIs, designs, trademarks, logos, texts, data structures, and related materials are owned by Kiwi or its licensors. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Platform except as permitted by law or written agreement.
You retain ownership of your submitted content, subject to the license granted in these Terms.
Our collection and use of personal data is described in our Privacy Policy. By using the Platform, you acknowledge that we process personal data as described there.
We may suspend, restrict, or terminate access to the Platform if we believe you violated these Terms, created risk, harmed another user, failed verification, failed to pay amounts owed, misused the Platform, or if required by law.
You may stop using the Platform at any time. Some obligations survive termination, including payment obligations, dispute terms, intellectual property rights, confidentiality, content licenses, and limitations of liability.
To the maximum extent permitted by law, the Platform is provided "as is" and "as available". Kiwi does not guarantee the quality, safety, legality, availability, accuracy, timing, pricing, staff performance, product condition, or outcome of services or products provided by third-party providers.
Providers and customers are responsible for their own interactions, transactions, and compliance with applicable law.
To the maximum extent permitted by law, Kiwi and its affiliates, officers, employees, agents, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or unauthorized access arising from or related to the Platform.
Where liability cannot be excluded, Kiwi's liability will be limited to the greater of: (a) the amount you paid to Kiwi for the relevant service during the three months before the claim; or (b) [insert local statutory minimum if applicable].
You agree to defend, indemnify, and hold Kiwi harmless from claims, losses, damages, liabilities, costs, and expenses arising from your use of the Platform, your content, your products or services, your breach of these Terms, your violation of law, or your infringement of another person's rights.
These Terms are governed by the laws of [insert governing jurisdiction], without regard to conflict-of-law rules.
Before filing a formal claim, you agree to contact us at [legal/support email] and try to resolve the dispute informally. Any unresolved dispute will be submitted to the courts or dispute resolution forum located in [insert venue], unless applicable law requires otherwise.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. If changes are material, we may provide additional notice through the Platform, email, SMS, or other reasonable means.
Your continued use of the Platform after the effective date means you accept the updated Terms.
